Terms of Service

1. Agreement to Terms

By accessing or using QCS Cargo ("we," "us," or "our") services, website, or applications, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

These Terms apply to all users of our services, including customers, website visitors, and anyone who interacts with QCS Cargo in any capacity.

2. Description of Services

QCS Cargo provides air freight shipping services between the United States and Caribbean destinations, including:

  • Standard air freight shipping
  • Express delivery services
  • Door-to-door pickup and delivery
  • Consolidated cargo services
  • Customs clearance assistance
  • Special handling for fragile or high-value items

3. Booking and Payment

3.1 Booking Requirements

To book a shipment, you must:

  • Be at least 18 years of age
  • Provide accurate and complete information about yourself and your shipment
  • Have legal authority to ship the items you are sending
  • Agree to our shipping policies and restrictions

3.2 Payment Terms

  • Payment is required at the time of booking unless otherwise agreed in writing
  • We accept major credit cards, debit cards, and approved payment methods
  • All prices are in US Dollars (USD) unless otherwise specified
  • Prices are subject to change without notice

3.3 Weight and Dimensional Charges

Shipping charges are based on the greater of actual weight or dimensional weight. Dimensional weight is calculated as (Length × Width × Height) ÷ 166 cubic inches per pound. If the actual weight at our warehouse differs from your declared weight by more than 10%, you may be charged additional fees.

4. Prohibited and Restricted Items

You agree not to ship any items that are:

  • Illegal under US, international, or destination country laws
  • Explosives, firearms, ammunition, or weapons
  • Illegal drugs or narcotics
  • Hazardous materials (flammables, corrosives, radioactives)
  • Live animals
  • Perishable goods without prior arrangement
  • Currency, bearer instruments, or negotiable securities
  • Counterfeit or pirated goods

5. Shipping and Delivery

5.1 Transit Times

Transit times are estimates and not guarantees. Delays may occur due to weather, customs clearance, carrier issues, or other circumstances beyond our control. We are not liable for delays unless explicitly covered by a service guarantee.

5.2 Delivery

Delivery is considered complete when the shipment is delivered to the address provided or to a customs facility in the destination country, depending on the service selected. For door-to-door service, delivery is complete upon receipt by any person at the delivery address.

5.3 Failed Delivery

If delivery cannot be completed due to incorrect address, recipient unavailability, or other reasons, additional fees may apply for redelivery or return shipping.

6. Liability and Insurance

6.1 Limitation of Liability

Our liability for loss or damage to shipments is limited to the lesser of the actual value of the goods or $100 per shipment, unless you purchase additional insurance coverage. We are not liable for:

  • Consequential, incidental, or indirect damages
  • Loss of business, revenue, or profits
  • Delays not caused by our gross negligence
  • Damage due to inadequate packaging by the shipper
  • Confiscation by customs or government authorities

6.2 Insurance

We offer optional shipping insurance at 2% of declared value (minimum $5). We strongly recommend insurance for valuable items. Claims must be filed within 14 days of delivery or expected delivery date.

7. Cancellations and Refunds

  • Free cancellation up to 12 hours before scheduled drop-off time
  • Cancellations within 12 hours may incur a $15 cancellation fee
  • No refunds for shipments already in transit
  • Refunds are processed within 5-10 business days to the original payment method

8. User Accounts

If you create an account with us, you are responsible for maintaining the security of your account and all activities under your account. You agree to:

  • Provide accurate registration information
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all account activity

9. Intellectual Property

All content on our website, including text, graphics, logos, and software, is the property of QCS Cargo or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

10. Indemnification

You agree to indemnify and hold harmless QCS Cargo, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services, violation of these Terms, or infringement of any rights of third parties.

11. Dispute Resolution

Any disputes arising from these Terms or our services shall be resolved through binding arbitration in the State of New Jersey in accordance with the rules of the American Arbitration Association. You waive any right to participate in class action lawsuits against QCS Cargo.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services constitutes acceptance of the modified Terms.
